1. Acceptance of Terms
By accessing and using WizLeads ("we", "us", or the "Service"), you ("Customer" or "you") accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
WizLeads is a cloud-based LinkedIn Sales Navigator scraper that allows Customers to extract prospect data from LinkedIn Sales Navigator searches. The Service provides data export functionality and supports both account-connected and account-less scraping modes.
3. User Responsibilities
You agree to:
- Use the service in compliance with all applicable laws and LinkedIn's Terms of Service
- Not use the service for spam, harassment, or any illegal activities
- Procure requisite permissions for accessing websites and data through the service
- Abstain from extracting substantial portions of databases in violation of third-party rights
- Refrain from unauthorized access to confidential or proprietary information
- Observe all third-party rights, including but not limited to copyrights, patents, trademarks, trade secrets, and other intellectual property or proprietary rights
- Comply with all pertinent laws, statutes, ordinances, and regulations, inclusive of those related to the protection of personal data (including GDPR and other data protection laws)
- Respect rate limits and usage guidelines
- Maintain the confidentiality of your account credentials
- Not share, resell, or redistribute the service without permission
You acknowledge that we exercise no prior control over your use of the Service, data collection activities, or content generated through the platform. You recognize that we shall bear no liability for your non-compliance with the stipulations set forth in this section.
4. Account Security
While we implement security measures to protect connected LinkedIn accounts, you acknowledge that:
- Account safety cannot be 100% guaranteed
- You use the service at your own risk regarding account restrictions
- We are not liable for any LinkedIn account suspensions or restrictions
5. Payment and Billing
By subscribing to the Service, you agree to:
- Pay all fees associated with your chosen subscription plan
- Automatic billing renewal unless cancelled
- No refunds for partial months or unused credits, except as specified in the Refund Policy below
- We reserve the right to modify pricing at any time
5.1 Refund Policy
A refund of the most recent subscription fee may be granted when you request it within ten (10) calendar days of the charge and no billable resources (such as credits) have been consumed in that billing period. Once any credits have been used, the fee becomes non-refundable.
6. Data Usage and Privacy
We collect and process data as outlined in our Privacy Policy. By using the service, you consent to such processing and represent that all data provided is accurate. We do not sell, share, or disclose your data to third parties. Your data remains your exclusive property.
7. Marketing License
By creating an account, you grant us a perpetual worldwide license to use your company's name and logo(s) for the sole purpose of our marketing and sales efforts, such as listing you as a customer on our website, in case studies, or in promotional materials.
You may revoke this license at any time by notifying us via email. We shall provide receipt confirmation of such notification and a response providing details on the follow-up to the request for revocation within 30 days following the notification.
You guarantee that you have the full right to grant this license to us.
8. Force Majeure
Neither you nor we can be held liable for the non-fulfillment of obligations if such non-fulfillment is due to a case of force majeure (e.g., fire incident, natural disasters, abrupt end of LinkedIn services, government restrictions, network failures, or other events beyond reasonable control). A party invoking force majeure is required to report this without delay to the other party via email.
9. Limitation of Liability
We shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use or inability to use the Service, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
10. Service Availability
We strive to maintain high service availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that may temporarily affect service availability.
11. Termination
We reserve the right to terminate or suspend access to the service immediately, without prior notice or liability, for any reason, including violation of these Terms of Service.
12. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of the service after changes constitutes acceptance of the new terms.
